We recommend consulting a professional technician before installation. heavyequipus is not liable for damages resulting from incorrect installation, misuse, or incompatibility.

3. Orders and Acceptance

3.1 Order Process

Your placement of an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Unavailability of products.

  • Errors in pricing or product description.

  • Suspected fraud or unauthorized use of payment methods.

3.2 Pricing Errors

In the event of a pricing error on the Site, we reserve the right to cancel any orders placed for the product listed at the incorrect price. We are not obligated to deliver any product at the incorrect lower price.

3.3 Sales Tax

Sales tax may be applied to orders based on the shipping destination and applicable laws.

4. Payment Terms

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

5. Shipping and Delivery

Shipping terms are governed by our Shipping & Returns Policy.

  • Free Shipping: Estimated delivery between 7 to 21 business days.

  • Fast Shipping: Available for an additional $180, with estimated delivery between 5 to 11 business days.

We are not responsible for delays caused by customs, incorrect address information provided by the customer, or carrier delays outside of our control.

6. Returns and Refunds

Returns are accepted within 30 days of delivery, subject to the conditions outlined in our Shipping & Returns Policy. Items must be unused and in original packaging. Please refer to the specific policy for details on restocking fees and return shipping costs.

You agree not to use the Site for any unlawful purpose or to solicit others to perform or participate in any unlawful acts. You agree not to:

9.1 Warranty Disclaimer

HeavyEquipus provides a limited warranty on certain products sold through this website. All car lifts are covered by a three (3) year warranty from the date of purchase. Each lift is supplied with an official certificate issued by the manufacturer, confirming compliance with applicable standards and specifications.

Excavators, trailers, and other equipment may be covered by separate warranties depending on the manufacturer and product type. Details of any applicable warranty will be provided at the time of purchase or upon request.

9.2 Limitation of Liability

To the fullest extent permitted by applicable law, HeavyEquipus shall not be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, our products or services.

Nothing in this section shall limit or exclude liability for death, personal injury, defective products, or any liability that cannot be excluded under applicable law.

9.3 Safety Warning

Heavy equipment and related parts can be hazardous if not used properly. By purchasing and using our products, you agree to operate them in accordance with all applicable safety instructions, standards, and regulations.

You are responsible for ensuring proper installation, operation, and maintenance of the equipment. HeavyEquipus shall not be liable for damages or injuries resulting from misuse, improper installation, or failure to follow safety guidelines.

Nothing in this section shall limit or exclude liability for defects in products or any liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless heavyequipus and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
